By booking our services, using our website, or participating in our tours, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.

3. Services Description

watermdori provides guided cycling tours throughout the Netherlands, including:

  • Half-day cycling tours
  • Full-day cycling adventures
  • Multi-day cycling holidays
  • Custom cycling experiences
  • Bicycle rental and equipment provision
  • Professional guide services

All services are subject to availability and weather conditions. We reserve the right to modify tour itineraries for safety reasons or due to circumstances beyond our control.

4. Booking and Payment Terms

4.1 Booking Process

  • All bookings must be made through our official website or by contacting us directly
  • Bookings are confirmed upon receipt of payment and written confirmation from watermdori
  • We recommend booking at least 48 hours in advance
  • Group bookings may require additional advance notice

4.2 Payment Terms

  • Full payment is required at the time of booking for tours under €200
  • Tours over €200 require a 50% deposit with balance due 7 days before the tour date
  • We accept major credit cards and bank transfers
  • All prices are in Euros (EUR) and include applicable VAT
  • Prices are subject to change without notice until booking is confirmed

4.3 Group Bookings

Special terms may apply for groups of 10 or more participants. Please contact us directly for group pricing and payment arrangements.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 24 hours before tour: Full refund
  • Less than 24 hours before tour: 50% refund
  • No-show: No refund
  • Multi-day tours: Special cancellation terms apply, detailed in booking confirmation

5.2 watermdori Cancellations

We reserve the right to cancel tours due to:

  • Severe weather conditions or safety concerns
  • Insufficient bookings (minimum 2 participants required)
  • Force majeure events
  • Equipment failure or safety issues

In case of cancellation by watermdori, you will receive a full refund or the option to reschedule at no additional cost.

5.3 Refund Processing

Refunds will be processed within 5-10 business days to the original payment method. Bank transfer fees, if any, will be deducted from the refund amount.

6. Participant Obligations and Requirements

6.1 Age and Fitness Requirements

  • Participants must be at least 12 years old unless specifically stated otherwise
  • Children under 18 must be accompanied by an adult
  • Participants should have basic cycling ability and reasonable fitness
  • Medical conditions that may affect participation must be disclosed at booking

6.2 Behaviour and Conduct

Participants must:

  • Follow all safety instructions and guidance from tour guides
  • Respect other participants, guides, and local communities
  • Not be under the influence of alcohol or drugs during tours
  • Take reasonable care of provided equipment
  • Arrive punctually at designated meeting points

6.3 Right to Refuse Service

We reserve the right to refuse service or remove participants who violate these terms, pose a safety risk, or disrupt the tour experience. No refund will be provided in such cases.

7. Safety and Equipment

7.1 Equipment Provision

  • We provide well-maintained bicycles suitable for tour routes
  • Safety equipment including helmets and lights are provided
  • Participants are responsible for checking equipment before use
  • Any equipment damage due to misuse will be charged to the participant

7.2 Safety Measures

  • All tours are led by trained and certified guides
  • Routes are chosen for safety and suitability
  • Emergency procedures are in place for all tours
  • First aid equipment is carried on all tours

7.3 Weather Conditions

Tours operate in light rain and mild weather conditions. In case of severe weather, tours may be modified, postponed, or cancelled for safety reasons.

8. Liability and Insurance

8.1 Limitation of Liability

watermdori B.V. carries comprehensive liability insurance as required by Dutch law. However, participation in cycling tours involves inherent risks, and participants join tours at their own risk.

Our liability is limited to:

  • Direct damages caused by our negligence
  • The amount covered by our insurance policies
  • The total value of the tour booking

8.2 Participant Insurance

We strongly recommend that all participants have:

  • Personal travel insurance
  • Medical insurance covering cycling activities
  • Personal liability insurance

8.3 Excluded Liability

watermdori is not liable for:

  • Personal injury due to participant negligence
  • Loss or damage to personal belongings
  • Indirect or consequential damages
  • Delays or changes due to weather or force majeure
  • Actions of third parties

9. Intellectual Property

All content on our website, including text, images, logos, and tour descriptions, is the property of watermdori B.V. and protected by copyright and other intellectual property laws.

You may not reproduce, distribute, or use our content without written permission. Tour participants consent to photography and videography during tours for promotional purposes unless specifically opted out.

10. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which complies with GDPR and Dutch privacy laws.

11. Force Majeure

watermdori shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to:

  • Pandemics or public health emergencies
  • Acts of terrorism or civil unrest

In such cases, we will work with participants to reschedule tours or provide appropriate alternatives.

12. Modifications to Services and Terms

watermdori reserves the right to:

  • Modify tour itineraries for safety or operational reasons
  • Update these Terms of Service with reasonable notice
  • Change pricing for future bookings
  • Discontinue services with appropriate notice

Significant changes to these Terms will be communicated via email or website notification. Continued use of our services constitutes acceptance of modified terms.

13. Governing Law and Jurisdiction

These Terms of Service are governed by Dutch law. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the Dutch courts.

We will make reasonable efforts to resolve any disputes through direct communication before pursuing legal action.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Invalid provisions shall be replaced with valid provisions that most closely reflect the original intent.
